An Act to provide for better organisation and development of education in the Non-Government educational institutions in the State of Rajasthan.
Be it enacted by the Rajasthan State Legislature in the Fortieth Year of the Republic of India as follows:
राजस्थान राज्य में गैर-सरकारी शैक्षिक संस्थाओं में शिक्षा के बेहतर संगठन और विकास के लिए उपबन्ध करने हेतु अधिनियम।
भारत गणराज्य के चालीसवें वर्ष में राजस्थान राज्य विधान मण्डल निम्नलिखित अधिनियम बनाता है:-

Preliminary
प्रारम्भिक
1.Short title, extent and commencement (1) This Act may be called the Rajasthan Non-Government Educational Institutions Act, 1989.
(2) It extends to the whole of the State of Rajasthan.
(3) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint and different dates may be appointed for different provisions of the Act and any reference to the commencement of this Act in relation to any provision thereof shall be construed as a reference to the date on which that provision comes into force.

1.संक्षिप्त नाम, प्रसार और प्रारम्भ.-(1) इस अधिनियम का नाम राजस्थान गैर सरकारी शैक्षणिक संस्थान अधिनियम, 1989 है।
(2) इसका प्रसार सम्पूर्ण राजस्थान राज्य में है।
(3) यह ऐसी तारीख को प्रवृत्त होगा जिसे राज्य सरकार राज-पत्र में अधिसूचना द्वारा नियत करे और अधिनियम के भिन्न-भिन्न उपबन्धों के लिये भिन्न-भिन्न तारीखें नियत की जा सकेंगी तथा उसके किसी भी उपबन्ध के संबंध में उसके प्रारम्भ के प्रति किसी भी निर्देश का अर्थ उस तारीख के प्रति निर्देश के रूप में लगाया जायेगा जिसको वह उपबन्ध प्रवृत्त होता है।
2.Definitions – In this Act, unless the context otherwise requires – (a) “aid” means any aid granted to a recognised educational institution by the State Government
(b) “aided institution” means a recognised institution which is receiving aid in the form of maintenance grant from the State Government;
(c) “Board” means the Board of Secondary Education, Rajasthan or the Central Board of Secondary Education, Delhi and shall include the Council for the Indian School Certificate Examinations:
(d) “compensatory allowance” means an allowance granted to meet personal expenditure necessitated by the special circumstances in which duty is performed and shall include a travelling allowance but shall not include a sumptuary allowance nor the grant of a free passage to or from any place outside India;
(e) “Competent Authority” means any officer or authority authorised by the State Government, by notification, to perform the functions of the competent authority under this Act for such area or in relation to such class of recognised Non-Governmenteducational institutions as may be specified in the notification.
(f) ‘’Director of Education” means,-
(i) in relation to degree and post-graduate colleges and educational institutions of equal or higher studies other than institutions of Sanskrit and technical education, the Director of College Education, Rajasthan;
(ii) in relation to the institutions of Sanskrit education, the Director of Sanskrit Education, Rajasthan
(iii) in relation to the institutions of technical education, the Director of Technical Education, Rajasthan;
(iv) in relation to schools and institutions other than those referred to in sub-clauses (i), (ii) and (iii) the Director of Primary and Secondary Education, Rajasthan:
Explanation- The Director of Education shall include any other officer authorised by him to perform all or any of the functions of the Director of Education under this Act:
(g) “District Education Officer includes, in relation to girls institutions, the District Education Officer (Girls) and also any other officer authorised by the State Government to perform the functions of such an officer,
(h) “Educational Society” or “educational agency” means any trust, person or body of persons permitted to establish or maintain a recognised non-Government educational institution;
(i) “employee” includes a teacher and every other employee working in a recognised institution;
(j) “existing institution” means any recognised institution established before the commencement of this Act and continuing as such at such commencement:
(k) Head of an institution” means the Principal Academic Officer, by whatever name called, of an institution;
(l) “institution” includes all movable and immovable properties pertaining to an educational institution,
(m) “Joint Director” or “Deputy Director” includes an officer authorised by the State Government to perform the functions of a Joint Director or Deputy Director,
(n) “Maintenance grant” means such recurring grant-in-aid to an institution as the State Government may, by general or special order, direct to be treated as such grant;
(o) “management” or managing committee”, in relation to any institution, means the committee of management constituted under section 9 and includes the Secretary or any other person, by whatever name designated, vested with the authority to manage and conduct the affairs of the institution;
(p) “non-Government educational institution” means any college, school, training institute or any other institution, by whatever name designated, established and run with the object of imparting education or preparing or training students for obtaining any certificate, degree, diploma or any academic distinction recognised by the State or Central Government or functioning for the educational, cultural or physical development of the people in the State and which is neither owned nor managed by the State or Central Government or by any University or local authority or other authority owned or controlled by the State or Central Government;
(q) “recognised institution” means a non-Government educational institution affiliated to any University or recognised by the Board. Director of Education or any officer authorised by the State Government or the Director of Education in this behalf;
(r) “salary” means the aggregate of the emoluments of an employee including dearness allowance or any other allowance or relief for the time being payable to him but does not include compensatory allowance;
(s) “sanctioning authority” means an officer authorised by the State Government to sanction aid to such recognised educational institutions as the State Government may specify from time to time in accordance with the procedure to be prescribed;
(t) “State Government” means the Government of the State of Rajasthan;
(u) teacher” means a Professor, Reader or Lecturer and any other person, by whatever name designated, imparting instruction or training or conducting and guiding a research or training programme in a non-Government educational institution and includes the Head of the institution; and
(v) “University” means a University established by law in the State of Rajasthan.
2.परिभाषाएं.– जब तक सन्दर्भ से अन्यथा अपेक्षित न हो, इस अधिनियम में, (क) “सहायता” से राज्य सरकार द्वारा, किसी मान्यता प्राप्त शैक्षिक संस्था को दी गयी कोई भी सहायता अभिप्रेत है;
(ख) “सहायता प्राप्त संस्था” से ऐसी कोई मान्यता प्राप्त संस्था अभिप्रेत है जो राज्य सरकार
से अनुरक्षण अनुदान के रूप में सहायता प्राप्त कर रही है;
(ग) “बोर्ड” से माध्यमिक शिक्षा बोर्ड, राजस्थान या केन्द्रीय माध्यमिक शिक्षा बोर्ड, दिल्ली अभिप्रेत है और इनमें काउन्सिल फॉर दी इण्डियन स्कूल सर्टिफिकेट एग्नामिनेशन्स सम्मिलित है;
(घ) “प्रतिकरात्मक भत्ता” से ऐसे वैयक्तिक व्यय की पूर्ति करने के लिये दिया गया कोई भत्ता अभिप्रेत है जो उन विशेष परिस्थितियों में आवश्यक हो जिनमें कर्त्तव्यपालन किया जाये और इसमें कोई यात्रा भत्ता सम्मिलित होगा किन्तु कोई सत्कार भत्ता या भारत के बाहर के किसी भी स्थान तक या से नि:शुल्क यात्रा- अनुदान सम्मिलित नहीं होगा;
(ङ) “सक्षम प्राधिकारी” से राज्य सरकार द्वारा, ऐसे क्षेत्र के लिए या मान्यता प्राप्त गैर सरकारी शैक्षिक संस्थाओं के ऐसे वर्ग के सम्बन्ध में, जो कि अधिसूचना में विनिर्दिष्ट किया जाये, इस अधिनियम के अधीन सक्षम प्राधिकारी के कृत्यों का निर्वहण करने के लिए अधिसूचना द्वारा प्राधिकृत कोई भी अधिकारी या प्राधिकारी अभिप्रेत है;
(च) “शिक्षा निदेशक “से अभिप्रेत है
(i)स्नातक और स्नातकोत्तर महाविद्यालयों और तत्समान या उच्चतर अध्ययन की उन शैक्षिक संस्थाओं के सम्बन्ध में, जो संस्कृत और तकनीकी शिक्षा की संस्थाओं से भिन्न है, निदेशक, महाविद्यालय शिक्षा, राजस्थान;
(ii) संस्कृत शिक्षा की संस्थाओं के सम्बन्ध में, निदेशक, संस्कृत शिक्षा, राजस्थान (i) तकनीकी शिक्षा की संस्थाओं के सम्बन्ध में, निदेशक, तकनीकी शिक्षा, राजस्थान
(iv) विद्यालयों और उप-खण्ड (0.(ii) और (ii) में निर्दिष्ट से भिन्न संस्थाओं के सम्बन्ध में, निदेशक, प्राथमिक और माध्यमिक शिक्षा, राजस्थान
स्पष्टीकरण– शिक्षा निदेशक में, इस अधिनियम के अधीन शिक्षा निदेशक के सभी या किन्हीं भी कृत्यों का निर्वहण करने के लिए उसके द्वारा प्राधिकृत कोई भी अन्य अधिकारी सम्मिलित होगा;
(छ) “जिला शिक्षा अधिकारी” में बालिका संस्थाओं के सम्बन्ध में, जिला शिक्षा अधिकारी (बालिका) और ऐसे किसी भी अधिकारी के कृत्यों का निर्वहण करने के लिए राज्य सरकार द्वारा प्राधिकृत कोई अन्य अधिकारी भी सम्मिलित है;
(ज) “शैक्षिक सोसायटी’ या “शैक्षिक एजेन्सी” से किसी मान्यता प्राप्त गैर-सरकारी शैक्षिक संस्था को स्थापित या अनुरक्षित करने के लिए अनुज्ञात कोई न्यास, व्यक्ति या व्यक्तियों का निकाय अभिप्रेत है;
(झ) “कर्मचारी” में किसी मान्यता प्राप्त संस्था में काम करने वाला कोई अध्यापक और प्रत्येक अन्य कर्मचारी सम्मिलित है;
(ञ) “विद्यमान संस्था” से इस अधिनियम के प्रारम्भ के पूर्व स्थापित और ऐसे प्रारम्भ के
समय इस रूप में चल रही कोई भी मान्यता प्राप्त संस्था अभिप्रेत है;
(ट) “संस्था का प्रधान”से किसी संस्था का किसी भी नाम से जाना जाने वाला प्रधान शैक्षिक
अधिकारी अभिप्रेत है;
(ठ) “संस्था” में किसी शैक्षिक संस्था से सम्बन्धित सभी जंगम और स्थावर सम्पत्तियां सम्मिलित हैं;
(ड) “संयुक्त निदेशक” या “उप-निदेशक” में किसी संयुक्त निदेशक या किसी उप निदेशक के कृत्यों का निर्वहण करने के लिए राज्य सरकार द्वारा प्राधिकृत अधिकारी सम्मिलित है:
(ढ) “अनुरक्षण अनुदान” से किसी संस्था को दिया गया ऐसा आवर्ती सहायता अनुदान अभिप्रेत है जिसके ऐसे अनुदान के रूप में माने जाने का निदेश राज्य सरकार सामान्य या विशेष आदेश द्वारा दे;
(ण) किसी संस्था के सम्बन्ध में ” प्रबन्ध” या ” प्रबन्ध समिति” से धारा 9 के अधीन गठित प्रबन्ध समिति अभिप्रेत है और इसमें सचिव या किसी भी नाम से पदाभिहित कोई ऐसा अन्य व्यक्ति सम्मिलित है, जिसमें संस्था के कामकाज का प्रबन्ध और संचालन करने का प्राधिकार निहित किया गया है;
(त) “गैर सरकारी शैक्षिक संस्था” से ऐसा कोई महाविद्यालय, विद्यालय, प्रशिक्षण संस्था या किसी भी नाम से अभिहित कोई भी अन्य संस्था अभिप्रेत है जो शिक्षा देने या राज्य अथवा केन्द्रीय सरकार द्वारा मान्य कोई प्रमाण-पत्र, डिग्री, डिप्लोमा या कोई भी शैक्षिक विशिष्टता अभिप्राप्त करने के लिए छात्रों को तैयार करने या प्रशिक्षण देने के उद्देश्य स्थापित की गयी और चलायी जाती हो या जो राज्य में लोगों के शैक्षिक, सांस्कृतिक या शारीरिक विकास के लिये कार्य कर रही हो और जो राज्य या केन्द्रीय सरकार या किसी भी विश्वविद्यालय या स्थानीय प्राधिकरण या राज्य या केन्द्रीय सरकार के स्वामित्व या नियन्त्रण के अधीन के किसी अन्य प्राधिकरण के न तो स्वामित्वाधीन हो और न उसके द्वारा प्रवन्धित
(थ) “मान्यता प्राप्त संस्था” से किसी भी विश्वविद्यालय से सम्बद्ध अथवा बोर्ड, शिक्षा निदेशक या राज्य सरकार अथवा शिक्षा निदेशक के द्वारा इस निमित्त प्राधिकृत किसी भी अधिकारी के द्वारा मान्य कोई गैर-सरकारी शैक्षिक संस्था अभिप्रेत है;
(द) “वेतन” से किसी कर्मचारी की कुल परिलब्धियां अभिप्रेत हैं जिनमें उसे तत्समय संदेय महंगाई भक्ता या कोई भी अन्य भत्ता या अनुतोष सम्मिलित है किन्तु प्रतिकारात्मक भक्ता
सम्मिलित नहीं है;
(घ) “मंजूरी प्राधिकारी” से ऐसी मान्यता प्राप्त शैक्षिक संस्थाओं को, जिन्हें राज्य सरकार विहित की जाने वाली प्रक्रिया के अनुसार समय-समय पर विनिर्दिष्ट करे, सहायता मंजूर करने के लिए राज्य सरकार द्वारा प्राधिकृत कोई अधिकारी अभिप्रेत है; (न) “राज्य सरकार” से राजस्थान राज्य की सरकार अभिप्रेत है;
(प) “अध्यापक” से कोई आचार्य, उपाचार्य या प्राध्यापक और किसी गैर-सरकारी शैक्षिक संस्था में शिक्षा या प्रशिक्षण प्रदान करने वाला या अनुसंधान या किसी प्रशिक्षण कार्यक्रम का संचालन और मार्गदर्शन करने वाला किसी भी नाम से अभिहित कोई अन्य व्यक्ति अभिप्रेत है और इसमें संस्था का प्रधान सम्मिलित है; और
(फ) “विश्वविद्यालय” से राजस्थान राज्य में विधि द्वारा स्थापित कोई विश्वविद्यालय अभिप्रेत है।
