Managing Committee
प्रबन्ध समिति

9 Constitution of a managing committee – (1) There shall be constituted a managing committee for every recognised institution.

(2) The managing committee of every recognised institution shall elect a Secretary from amongst its members. An employee of the institution shall neither be the Secretary nor the treasurer.

(3) The Secretary will perform such functions and exercise such rights as may be prescribed.

9 प्रबन्ध समिति का गठन.- (1) प्रत्येक मान्यता प्राप्त संस्था के लिए एक प्रबन्ध समिति गठित की जायेगी।

(2) प्रत्येक मान्यता प्राप्त संस्था की प्रबन्ध समिति अपने सदस्यों में से ही एक सचिव निर्वाचित करेगी। संस्था का कोई भी कर्मचारी न तो सचिव होगा, न ही कोयपाल।

(3) सचिव ऐसे कृत्यों का निर्वहण और ऐसे अधिकारों का प्रयोग करेगा, जो विहित किये जायें।

10 Powers of the State Government to take over management – (1) Notwithstanding anything contained in any law for the time being in force, whenever it appears to the State Government that the managing committee of any recognised institution has neglected to perform any of the duties assigned to it by or under this Act or the rules made thereunder or has failed to manage the institution properly and that is has become necessary in the public interest to take over the management of such institution, it may, after giving to such managing committee a reasonable opportunity of showing cause against the proposed action, take over such management and appoint an administrator to exercise control over the assets of the institution and to run the institution for such period as the State Goverment may from time to time fix.

(2) Where, before the expiry of the period fixed under sub-section (1), the State Government is of opinion that it is not necessary to continue the management of the institution by an administrator, such management shall be restored to the managing committee.

^{1, 2}10. राज्य सरकार की प्रबन्ध ग्रहण करने की शक्ति.-(1) तत्समय प्रवृत्त किसी विधि में किसी बात के होते हुए भी राज्य सरकार को जब कभी ऐसा प्रतीत हो कि किसी मान्यता प्राप्त संस्था की प्रबन्ध समिति ने इस अधिनियम या तदधीन बनाये गये नियमों के द्वारा या अधीन उसे समनुदेशित किन्हीं भी कर्तव्यों के निर्वहण में उपेक्षा की है या वह संस्था का सभुचित रूप से प्रबन्ध करने में विफल रही है और यह कि ऐसी संस्था का प्रबन्ध ग्रहण करना लोकहित में आवश्यक हो गया है तो वह ऐसी संस्था की प्रबन्ध समिति को प्रस्तावित कार्रवाई के विरुद्ध हेतुक दर्शित करने का युक्तियुक्त अवसर देने के पश्चात् ऐसे प्रबन्ध को ग्रहण कर लेगी और ऐसी कालावधि के लिये जो राज्य सरकार समय-समय पर नियत करे, संस्था की आस्तियों पर नियन्त्रण रखने तथा संस्था को चलाने के लिए प्रशासक नियुक्त कर सकेगी।

1. आदेश क्रमांक प. 19 (9) शिक्षा-5/93, दिनांक 11.8.2000- गैर सरकारी शैक्षिक संस्थाओं में राजकीय सेवा में कार्यरत अधिकारियों को प्रशासक नियुक्त किया जाय एवं जिन भी संस्थाओं में प्रशासक लगे हुए एक वर्ष से अधिक समय हो गया, उन संस्थाओं के चुनाव कराये जाने की आवश्यक व्यवस्था के संबंध में ( आदेश संख्या 103)।
2. आदेश क्रमांक प. 19 (9) शिक्षा-5/93, दिनांक 15.9.2001- गैर सरकारी शैक्षिक संस्थाओं में प्रशासक लगाये जाने के संबंध में नीति ( आदेश संख्या-126)।

(2) जहां, उप-धारा (1) के अधीन नियत कालावधि की समाप्ति के पूर्व, राज्य सरकार की यह राय हो कि संस्था का प्रबन्ध प्रशासक के द्वारा चलाये जाते रहना आवश्यक नहीं है वहां ऐसा प्रबन्ध-प्रबन्ध समिति को प्रत्यावर्तित कर दिया जायेगा।
